Settlement obtained following death of asbestosis sufferer

Martyn Hayward, an asbestos-related disease claim specialist at Ashtons Legal, has obtained a five-figure settlement for the partner of Mr W, a former maintenance and boiler house operative, who died in 2019.

Although Mr W died in his 70s following a cardiac arrest, he had previously received a diagnosis of asbestosis. Medical experts determined that Mr W’s asbestosis rendered his body unable to cope with his cardiac event.

Mr W was exposed to asbestos dust while employed by a brewery in Norwich for a period in the early 1960s and again in the 1980s. As part of his job, he mixed asbestos powder and water and applied it to pipework, tanks and boilers. He also stripped asbestos lagging to carry out repair. It was admitted by his employer that they were in breach of safety regulations.

Martyn comments: “Bringing an injury claim for an asbestos-related disease after someone’s death can be difficult because the person is no longer around to describe the exposure to asbestos that they experienced. In this case, we had to ask experts to undertake a fibre count of the asbestos fibres in a lung tissue sample after Mr W’s death. His partner chose to bring the claim because she wanted his former employer to acknowledge that they were to blame for exposing Mr W to asbestos without protection, leading to his illness and subsequent death.”
