Birth Injury Claims Solicitors

At Ashtons Legal, we understand that for most parents, welcoming a new child into the world will be one of the happiest days of their lives. However for some parents, this exciting day can quickly turn into a traumatic one due to mistakes made by medical professionals.

If you feel that you, your loved one, or your baby were unnecessarily injured during childbirth as a direct result of medical negligence, then you may be able to claim compensation.

We understand that no amount of money can take away the emotional and physical suffering that negligent care can cause. However, compensation can cover any medical or rehabilitation expenses, and it can make up for any money that was lost if your injuries left you unable to work.

What constitutes a birth injury?

Birth injuries to mothers

As a woman, you should feel confident in the care you are being given by your midwives, doctors and nurses around the time of your labour and delivery. Whilst most women are fortunate enough to receive excellent care from the medical staff looking after them during this time, mistakes can still be made.

Birth injury claims that our solicitors will be able to help you with include:

  • third and fourth-degree perineal tears
  • organ damage during caesarean sections
  • fissures
  • anaesthetic errors
  • failure to recognise or manage pregnancy complications.
Birth injuries to babies

It’s not uncommon for babies to experience minor health complications during birth. However, these unforeseen issues are usually quickly treated and resolved by the medical staff on hand.

Unfortunately, these complications are sometimes not recognised and not treated correctly by medical professionals. Negligence during pregnancy may leave babies with injuries that with adequate care could have been avoided. Whether it be an injury that heals within a few weeks, or a severe, life-changing injury that requires ongoing support, at Ashtons Legal we understand that these avoidable complications can have a devastating impact on families.

Birth injury claims that our solicitors will be able to help you with include:

  • cerebral palsy
  • brain injury
  • stillbirth
  • broken bones.

Can I make a birth injury claim?

Anyone who has suffered an injury during labour or delivery that was partly, or entirely caused by medical negligence may have a birth injury claim. If you are unsure, feel free to get in touch with us by calling 0330 404 0772 or by filling out this enquiry form and we will be able to help you with any questions or concerns you may have.

What is the time limit for making a birth injury claim?

You can start your claim at any time before your child turns 18. Once your child is 18, they will have up until their 21st birthday to start a claim.

If you are claiming in respect of a child that has died as a result of medical negligence, then you have three years from the date of death to begin your claim.
