Settlement for a woman who underwent incorrect surgery

Ruth Houghton, a lawyer in our Medical Negligence team, has obtained a settlement for a woman who underwent an incorrect surgical procedure.

Mrs SP suffered from a hammertoe and was consulted by her orthopaedic surgeon for corrective surgery. However, he failed to perform an appropriate assessment or discuss the suitable range of procedures available for her to undergo. As a result, she suffered avoidable complications of an incorrect procedure, namely deformity, pain and numbness.

The Claim was initially denied in its entirety by the Defendant hospital. However, upon challenging and disputing the arguments raised, a settlement was awarded to Mrs SP for her pain and suffering, which could have been prevented.

Ruth Houghton, Medical Negligence Executive, comments: “Whilst Mrs SP will continue to suffer from the complications of this surgery, this was a good result considering that the Defendant had completely denied any liability in the first instance. She now has the ability to pay for specialist treatment to help ease her ongoing problems and manage her pain”.
