How much compensation can you claim for an amputation?

The level of amputation compensation you may be entitled to depends on the nature and severity of your injury, your age, your employment, and the extent of your future care and support needs. Compensation falls into two broad categories: general damages (for pain, suffering and loss of amenity) and special damages (for financial losses, including lost earnings, care costs and the cost of prosthetics and rehabilitation).

The Judicial College Guidelines (JCG) provide a framework for general damages in amputation cases. As a broad indication:

  • Toe and finger amputations: Settlements typically range from several thousand pounds to over £100,000, depending on the number and significance of the digits lost.
  • Hand or foot amputation: Claims can reach into the hundreds of thousands when the full picture of loss is accounted for.
  • Single arm or leg amputation: Six-figure settlements are common, and cases involving significant loss of function or long-term care needs frequently exceed £200,000 in total.
  • Multiple limb loss or catastrophic amputation: Settlements of several million pounds are achievable where lifelong care, specialist accommodation and substantial lost earnings are included.

Time limits for making an amputation claim

In most cases, you have three years from the date of your accident or, where this differs, the date on which you first had reason to believe that negligence caused your injury. In medical negligence cases in particular, identifying that date can require careful legal analysis.

Exceptions apply, for example, where the injured person is under 18 (the three-year period doesn’t begin until their eighteenth birthday) or where someone lacks the mental capacity to conduct legal proceedings. Also, different time limits may apply (usually shorter) depending on where the injury was suffered (for example, on board a ship).
