£50k interim payment for secondary exposure to asbestos

Martyn Hayward, an asbestos-related disease specialist solicitor, has secured a £50,000 interim payment for secondary exposure mesothelioma.

Mrs D has been diagnosed with asbestos related mesothelioma, which was contracted after washing her husband’s asbestos contaminated overalls.

Mr D was a caretaker in Dagenham who raised concerns about the lagging on the pipework in the boiler house where he was employed. He was told by his employer that the pipe insulation wasn’t asbestos and he should continue working in the boiler house, as it was part of his duties.

Eventually, the lagging was analysed and found to be asbestos. It was finally removed in 1997, years after Mrs D’s husband commenced his employment.

The Royal Courts of Justice in London ordered the London Borough of Barking & Dagenham to pay an interim payment of £50,000 to Mrs D, with damages to be assessed at a later date.
