Six figure settlement secured for mesothelioma sufferer’s family

Martyn Hayward, a solicitor specialising in asbestos-related disease claims at Ashtons Legal, has obtained a settlement for the estate of Mr T, who sadly died in 2019 after a short battle with mesothelioma.

Mr T’s first exposure to asbestos was during his carpentry apprenticeship which he started in the late 1950s. He worked alongside laggers and remembered there being “visible clouds of dust” created by cutting the asbestos. He then went on to cut asbestos in his own right on a variety of building jobs across South East London and Essex spanning the time of his apprenticeship through to the late 1980s.

In particular, he remembered cutting asbestolux sheets for soffits and then fixing them into place. He reported that cutting them with a circular saw was “like working in a snowstorm”. The act of fixing them in place then resulted in the asbestos dust falling onto his face. Not inhaling it was not an option.

Martyn comments: “No respiratory protection or warnings were given to Mr T or any of his other building site colleagues by any of the former employers involved in this claim. Sadly, by the time Mr T was diagnosed with mesothelioma, the disease was already at an advanced stage and the claim has had to be completed after his untimely death.”
