Six figure settlement for girl injured when learning to abseil

Roger Loomes, a personal injury specialist at Ashtons Legal, has obtained a significant financial settlement to help Ms P, now in her 20s, to get her life back on track after a back injury.

Ms P went on a course to learn to abseil and ended up falling and hurting her back, primarily because the abseil rope stopped short rather than reaching the ground. The organisers of the course denied that they had failed to instruct her properly on what to do when she reached the bottom of the rope.

Ms P now suffers from low back pain which is likely to be permanent and which has triggered functional chronic pain and paralysis leaving her reliant on a wheelchair. She continues to need rehabilitation and her long-term prognosis is uncertain.

Roger comments: “One of the key aspects to the success we had, in this case, was in our selection of experts. We had helpful video and photographic evidence of the incident which assisted us in our forensic analysis of the liability issues. Functional disorders are always tricky and I was delighted to work with an internationally renowned specialist in this field. It is hoped that with continuing rehabilitation, Ms P will eventually stop being reliant on a wheelchair. The settlement we have achieved will help her to fund additional support and will also enable her to start to get her life back on track in other ways.”
