Asbestosis claim settled for Norfolk pipe fitter
Martyn Hayward, a specialist asbestos-related disease solicitor at Ashtons Legal, has successfully settled a personal injury claim for the estate of a Norwich man who died after contracting asbestosis.
Mr T, who was retired, spent his working life as a pipe fitter. During the course of his employment, he worked for several different companies across East Anglia, all of whom exposed him to asbestos to a greater or lesser extent.
Mr P was regularly exposed to asbestos when working alongside laggers who mixed the asbestos powder with water. The resulting asbestos dust and fibre particles were clearly visible across their workplace. Mr P was also required to strip asbestos insulation from pipes to gain access to valves for maintenance. As was often the case during the 1960s and 1970s no warnings were ever given and no respiratory protection was provided.
Martyn Hayward comments: “Unfortunately, as is often the case with asbestos-related diseases, Mr P’s health deteriorated rapidly once his symptoms started to emerge many years after the exposure to asbestos occurred. Towards the end of his life, he required portable oxygen to aid his breathing and was eventually unable to move about his house at all due to his chronic breathlessness. Fortunately, he had been able to provide substantial evidence of his exposure to asbestos and the insurers for his former employers agreed to settle his claim without the need to issue court proceedings. Sadly he did not live to see the outcome of the case but his family can have some closure knowing that the organisations responsible for his asbestos exposure have acknowledged the fact that they failed to protect him from exposure to asbestos dust.”
