£100,000 settlement obtained for a labourer injured at work
Louise Harper, a personal injury specialist at Ashtons Legal, has settled the claim of a Suffolk man, Mr H, who incurred a range of injuries when he fell through an open stairwell in a new-build house that was under construction.
Mr H, who is in his 50s, has been a building labourer for all of his working life but has not yet been able to return to work since incurring his injuries. He still suffers high levels of pain and psychiatric symptoms and struggles with various daily tasks and other activities as a result of the fall and the injuries he suffered.
Louise comments: “Both the property developer responsible for the building site and the contractor for whom Mr H worked denied full liability for his injuries. They believed that Mr H had also been in breach of normal site safety procedures, which would amount to what is known as ‘contributory negligence’.
“Given the complexities of proving this either way, Mr H preferred us to take a pragmatic approach on his behalf and settle his claim relatively quickly but for significantly more than the initial offer made by the insurers representing the developer and the contractor. We hope that Mr H will now be able to use his settlement money to help with his further rehabilitation and to cover his care costs and loss of earnings while he gets his life back on track.”
