Settlement secured for mother following preventable stillbirth

Ali Masterson, Medical Negligence specialist at Ashtons Legal, has recently settled a case involving baby loss.

Ali was instructed by AB in early 2024 to investigate a claim against Norfolk & Norwich University Hospital following the loss of her son just before birth.

AB had tested positive for Covid-19 at 39+6 weeks, and her next two midwifery review appointments were cancelled. When AB was finally seen by the community midwife over a week later, it was noted that there were concerns over slowed growth, and she was referred to the Hospital for a scan. The scan confirmed slowed growth, along with Oligohydramnios (low fluid). Induction of labour was arranged for two days later. When AB attended for induction, she raised concerns over the reduced fetal movements, and despite monitoring and assessment, the baby’s heart rate could not be located. AB’s baby was sadly born as a stillbirth. AB required ongoing support from NHS Wellbeing to provide CBT over the following two years to support her through her following pregnancy and return to work.

Ali comments: “I initially supported AB with her complaint to the Trust so that she could have some understanding of what had happened. Once the Perinatal Mortality Report was provided, and I had considered this with the medical records, the next step was to approach the Trust with a Letter of Claim, as I felt the matter could be settled without the need for expert evidence on breach and causation. The solicitors for the NHSR took a collaborative approach, and we were able to settle the matter relatively quickly by way of negotiation.”

“The loss of a child is heartbreaking, and no amount of money can ever compensate for that loss. What was most important to my client was the acknowledgement and admission from the Trust that, had they done more, her baby would have been born safely.”
