£600,000 injury claim settlement obtained following workplace accident

Ashtons Legal has recently settled the personal injury claim of Mr W, who is living with a brain injury, and audiovestibular and psychological symptoms, following an accident at work.

Mr W was working as a lorry driver, subcontracted out by his employer. He was unloading heavy trusses from the back of a flatbed lorry when the load tipped, knocking him off the lorry and onto the pavement. He hit his head, causing serious injury and long-term symptoms. Mr W is now unable to work and requires considerable assistance in many aspects of his life. Liability for the incident was strongly contested throughout.

Roger Loomes was the personal injury claim specialist advising Mr W. He comments: “This was not a straightforward claim because no one wished to take responsibility for what happened. We argued Mr W was required to work in an unsafe manner, without the required mechanical and or manual support and appropriate training. The defendants insisted that he had received safety training and had failed to follow it. We were due to go to Court in mid-2026 to establish who was to blame for his injuries, but we have now managed to agree a way forward with the insurers involved. This will enable Mr W to focus on getting his life back on track as best as he is able, given the life-changing injuries he suffered.”
