£10,000 obtained for construction worker who suffered facial injuries

Roger Loomes, a personal injury specialist at Ashtons Legal, has obtained a £10,000 settlement for a man who suffered dental and other facial injuries when hit by a scaffold pole. The accident arose because the construction worker’s visibility was unfortunately reduced by being required to wear safety goggles while working on the scaffolding. In fact, wearing safety goggles was not an appropriate requirement of that particular job and was not in line with the Personal Protective Equipment at Work Regulations 1992.
Roger comments: “Our client came to us having been turned away by another law firm who thought the claim was unlikely to succeed because blaming safety equipment for an injury is an unusual scenario. However, the important thing to remember with protective equipment is that it needs to be appropriate for the job being carried out and reducing the peripheral vision of someone working with scaffolding poles is unhelpful. This injury could and should have been avoided.
