£95,000 settlement obtained for woman whose smear test was reported incorrectly

Julie Crossley, a medical negligence specialist lawyer at Ashtons Legal, has settled the medical negligence claim of Ms T, who developed cervical cancer and had to undergo chemotherapy and radiotherapy two years after her smear test was reported as normal.

Expert medical opinion confirmed that her cervical smear should have been reported as severe dyskaryosis, and Ms T should have been referred for biopsy and treatment. If this had happened in a timely manner then she would probably not have developed cervical cancer.

Julie comments: “By the time Ms T was diagnosed with invasive squamous cell carcinoma she had a 5cm tumour and required both chemotherapy and several weeks of radiotherapy. The ongoing effects of the radiotherapy are painful, intrusive and lifelong with daily impact on her bowel, bladder and sexual function. Her local hospital Trust admitted liability.”
