Injury claim settled for seriously injured car driver

Alexandra Lush, a solicitor specialising in serious injury claims at Ashtons Legal, has obtained a six-figure settlement for Mr T, who was injured in a high-speed, high-impact road collision.

Mr T’s vehicle was struck from behind by a lorry, which was travelling at over 50 mph, and was shunted into the vehicle in front of him.

Mr T suffered a traumatic brain injury and a long list of fractures, soft tissue injuries, lacerations and bruising, plus an eye injury.

Although the majority of his direct physical symptoms resolved relatively quickly, Mr T has been left with fatigue, word-finding difficulties, impaired memory and concentration and reduced confidence. As a result of this, he has struggled to find paid employment since the incident, which occurred when he was in his mid-50s. He has also been unable to return to his pre-accident passion of riding motorbikes on the road which has had a negative effect on his social life as well as his general enjoyment of life.

Alexandra comments: “This was a difficult case because the lorry driver’s insurers were initially unconvinced about the severity of Mr T’s brain injury and also challenged whether the road traffic collision was the full cause of his ongoing cognitive issues. The case was due to go to Trial in early 2025, but we managed to reach a settlement agreement in December 2024. Mr T will now be able to focus fully on getting his life back on track as far as he is able, given the nature of his ongoing symptoms.”
