Six-figure injury claim settlement following childhood burn injury

Louise Harper, a personal injury specialist solicitor at Ashtons Legal, has obtained a six-figure settlement for Miss W, a young woman who suffered serious scalding as a young infant.

Miss W was being cared for in a nursery when a container of boiling water fell onto her. The nursery admitted full liability for Miss W’s injuries, but the long-term severity and impact of her injuries couldn’t be accurately diagnosed until she was fully grown, so it was only recently that her claim was able to be finalised.

Louise comments: “Miss W’s injuries have had a profound impact on her life. Despite surgery, she was left with significant facial scarring, which, in particular, affected the way she was treated by her peers in her formative years. The scalding also affected one of her breasts, and she is planning to have surgery to correct the fact that her breasts are not symmetrical. She has ongoing issues in relation to needing to ensure that her scarring is not exposed to excessive sunlight. The damage done by the injury has been psychological as well as physical, and this is reflected in Miss W’s settlement. It is hoped that she will now be able to move forward and get her adult life fully on track.

The general rule applying to personal injury claims is that they have to be brought within three years of the incident occurring. However, where the injury is suffered by a child, this is extended and the time limit runs until three years from the injured person’s 18th birthday. This allows time, as in Miss W’s case, for full and proper medical evidence to be obtained, taking account of someone’s growth and physical development.”
