£530,000 settlement obtained for seriously injured worker

Ashtons has recently settled the personal injury claim of Mr D, whose life has dramatically changed as a result of a workplace incident. Mr D was employed as the driver of a concrete mixer and suffered a range of devastating injuries when he was crushed by a falling cone filled with concrete.

The most serious of his short-term injuries were to his back, while his longer-term symptoms are a mix of orthopaedic, cognitive, behavioural and psychological. He is likely to require further surgery on his wrist in due course and lives on a daily basis with both physical pain and cognitive difficulties.

Mr D’s claim was led by personal injury specialist Roger Loomes, who comments: “Mr D’s employers’ insurers admitted liability for the workplace accident and for his injuries, and he was given early access to rehabilitation support. However, sadly for Mr D, he has not been able to return to his previous employment, and a combination of his age, enduring symptoms, and skill set is making it very difficult for him to find alternative paid work. He was also a fit and active man who is now unable to participate in the recreational activities he enjoyed before his injury. The serious damage done to his wrists has also made it very difficult for him to do the household maintenance jobs that he would have undertaken previously.

“Mr D’s settlement will help to ensure that he is not out of pocket for the money that he would have earned in the coming years if he had not been injured. It is hoped that he will also be able to use some of it to improve his quality of life despite the physical and cognitive constraints that he now suffers”.
