Multi-million pound settlement obtained for Norfolk man injured in a road collision

A catastrophic injury specialist at Ashtons Legal, has obtained a seven-figure lump sum and six-figure annual payments for life for an elderly Norfolk man who is now wheelchair bound following a road traffic collision.

Mr B suffered severe spinal fractures when his car was hit from behind by a lorry in Norwich. In spite of surgery and multi-disciplinary rehabilitation, he remains tetraplegic and requires two full-time carers.

Ashtons comments: “At the time of the collision, Mr B was undertaking the role of full-time carer for his wife who only has partial sight. He was well and active for his age and had a range of hobbies and interests. His injuries have had a devastating effect on the lives of the whole family, and have required him to move to a wheelchair-friendly property with level access.

“Unusually, but very positively, after negotiation the defendant insurers agreed to buy a property for Mr B to rent for the remainder of his life as part of the settlement because the accommodation aspect of the claim was not large enough to enable him to buy his own property due to his short life expectancy.

“The other unusual aspect of this claim was that the police were unable to prosecute the lorry driver as he claimed to have had a sneezing fit and therefore have lost control of his vehicle. It is usually easier to win a claim where there is also a criminal prosecution but fortunately the lack of one did not stop us obtaining a very good settlement in the circumstances for Mr B.”
