£125,000 obtained following surgical damage to bile duct

Julie Crossley, a medical injury specialist at Ashtons Legal, has obtained a £125,000 damage settlement for Mr S after a routine gallbladder operation went wrong.

A surgeon’s error resulted in damage to his bile duct. This in turn resulted in a biliary leak and the need for three further corrective surgeries.

Mr S spent 15 months in recovery following his multiple surgeries and could not go back to working full time, which had financial impacts.

The Trust admitted liability and after an initial £70,000 compensation was rejected, the claim settled for £125,000.

Julie comments: “What should have been a simple procedure with a relatively short recovery time turned into a series of surgeries due to the error of the surgeon. As it took over a year for Mr S to fully recover, the complications have had a serious financial impact on Mr S’s life.”
