We work with our clients to avoid disputes wherever possible to minimise costs to their businesses. However, when a dispute becomes unavoidable, a commercial strategy needs to be adopted quickly.

Our skilled advisors are on hand to provide your business with dispute support. Whether you are looking to bring a claim to protect your business or you are defending a claim brought against you, we are here to help.

We act for a wide range of clients, from owner-managed and family businesses to national companies and public sector clients, reflecting our depth of knowledge.

Our Approach to Business Dispute Resolution

At the outset, it is important for any organisation involved in a dispute to take advice on their legal position and consider what the benefits and drawbacks are in engaging in the litigation or opting for a quick, early settlement through alternative dispute resolution.

At Ashtons Legal, we use pro-active litigation strategies, tried and tested by our experienced litigators, to plan the short, medium and latter stages of the litigation in order to meet our client’s objectives.

Whilst we are a firm with extensive experience taking cases all the way to trial (and winning) in the senior Courts, our pragmatic litigators cater their advice to our client’s goals and look to settle disputes on favourable commercial terms.

Our Commercial Dispute Resolution Expertise

Our team has a broad range of specialisms all under one roof and we have received outstanding client feedback in a variety of areas, including:

Acting for an international company in relation to an agency dispute worth c. £850,000 with its UK-based principal

The agency agreement reached between the parties was drafted without legal counsel and contained an incomplete choice of jurisdiction clause. One of the complex issues in the case was whether the laws of England and Wales or the laws of the state of Georgia or the laws of the province Ontario applied. This case was led by Partner and Chairman of the firm, Michael Frape.

Advising a large recycling company in connection with a multi-million-pound public procurement challenge under the Public Procurement Regulations 2016

The dispute concerns the transparency of the tendering process adopted by the public body and the method by which scores were reached by the assessors.

Defending the founding member of a timeshare resort in Gran Canaria, Spain in €2.5 million tax bill liability claim

Our client was the subject of a claim brought by the timeshare’s trustee company in respect of potential liability for a Spanish tax bill totalling approximately €2.5 million. After success in the High Court, the Claimant appealed the matter to the Court of Appeal, where we successfully defended the case for a second time.
