£9,500 obtained for ankle injury

Louise Harper, a member of Ashtons’ personal injury team, has obtained £9,500 for Ms A who fell down unmarked steps in a hotel and fractured her ankle.

The hotel’s insurers initially challenged Ms A’s claim on the basis that she “wasn’t looking where she was going” and then tried offering £4,500 before eventually agreeing a fair settlement given that the ankle fracture has left Ms A with permanent nuisance symptoms.

Louise comments: “This is a classic example of the sort of justice which is unlikely to be achieved if the PI reforms currently proposed by the Government are implemented. Ms A freely acknowledges that she wouldn’t have felt able to challenge the insurers in this way on her own. However, the £4,500 figure would fall under the proposed new small claims limit so legal costs would not be recoverable and Ms A would not therefore have enlisted our help. For the time being however, we are delighted to be able to continue to fight the corner of local people who suffer injury to ensure that they achieve the compensation they deserve for their injuries rather than the figure that the insurers would prefer to pay!”
