£50,000 obtained for elderly man who had unnecessary surgery

Julie Crossley, a medical negligence lawyer at Ashtons, has obtained a £50,000 settlement for Mr H, after he was left bedbound and incontinent following an operation that he needn’t have had.

Mr H was not examined as thoroughly as he should have been at the time of diagnosis and the full implications of the major surgery he underwent, as opposed to a possible more minor alternative, were not properly explained. Having undergone the surgery and suffered complications in his aftercare, Mr H has now totally lost his independence. At the time of the surgery he was mobile, just using a stick to help with his balance.

Julie comments: “There has been much in the media recently about the poor NHS care given to the elderly. Sadly this is a classic example of where sufficient time was not taken to go through the proper processes to ensure that Mr H was receiving the best treatment for his circumstances.”
