£29,000 obtained for injured cyclist following collision with van

Nick Peake, a personal injury specialist at Ashtons, has obtained a settlement of £29,000 for a Cambridgeshire cyclist who suffered shoulder and facial injuries after colliding with a van.

The man was using a cycle lane when the van stopped suddenly in front of him causing the Mr T to crash and fall to the ground resulting in injuries to his shoulder. Mr T suffered persistent left shoulder pain with reduced range of movement and had to take four weeks off work, resulting in a loss of earnings.

The van driver’s insurer initially disputed liability. The case was listed for trial, but before the case reached court, the insurer agreed to settle the matter and did not offer any evidence to contest liability. Mr T was awarded just over £29,000.

Nick Peake comments: “It can be difficult to prove that a motorist is at fault when a cyclist collides with the back of a vehicle. In this case the collision was witnessed by a former colleague of Mr T who saw the incident from a passing bus. The driver was clearly at fault as he pulled across in front of the cyclist and stopped, therefore Mr T was able to bring a claim and be compensated.”
